Scope
These Website Terms and Conditions govern use of the public TradeSpec MHE marketing website at tradespecmhe.com.
The authenticated TradeSpec application and customer subscriptions are separate services governed by their applicable agreements.
Public Website Purpose
The public website provides general information about TradeSpec and allows business and professional visitors to:
- Learn about the product
- Request a product walkthrough
- Ask questions
- Discuss pricing or product fit
- Contact TradeSpec MHE LLC
Requesting information or a walkthrough does not create an account, subscription, purchase obligation, software license, or customer relationship.
TradeSpec's Role
TradeSpec helps dealerships document equipment information, inspection observations, and supporting information for review.
TradeSpec does not determine equipment value, establish a purchase or trade allowance, certify equipment condition or safety, replace qualified personnel or manufacturer procedures, or guarantee that every defect or condition will be identified.
Dealerships and qualified personnel remain responsible for their inspections, equipment evaluations, and business decisions.
Permitted Use
You may use the public website for legitimate business purposes related to learning about or contacting TradeSpec.
You may not misuse the website, attempt unauthorized access, interfere with website operation or security, submit malicious material, or unlawfully use TradeSpec content.
TradeSpec may restrict access when reasonably necessary to protect the website, TradeSpec, its service providers, or other users.
Intellectual Property
TradeSpec MHE LLC retains its rights in the TradeSpec name, Trade/Spec MHE branding, website content, design, graphics, and other original materials.
These Website Terms do not transfer ownership of TradeSpec intellectual property or grant permission to use TradeSpec branding in a way that suggests endorsement, affiliation, or authorization.
Website Information and Availability
TradeSpec may update website information as the product, pricing, availability, or business practices change.
TradeSpec does not guarantee that the public website will always be available, uninterrupted, or error-free.
A separately executed customer or subscription agreement controls the matters covered by that agreement.
Disclaimer and Limitation of Liability
To the extent permitted by law, the public website and its content are provided for general informational purposes without a warranty that they will meet a particular business need or produce a particular result.
TradeSpec MHE LLC is not responsible for indirect, incidental, special, consequential, or punitive damages arising solely from access to, inability to access, or reliance on the public marketing website.
Nothing in these Terms excludes or limits a legal protection or liability that cannot lawfully be excluded or limited.
Governing Law
These Website Terms are governed by the laws of the State of New York.
They do not establish a particular county, court, arbitration requirement, or dispute venue.
